The recent unsolicited kiss by Luis Rubiales on Jennifer Hermoso after the World Cup final has sparked a case against him by Spain’s Administrative Sports Court (TAD). While the court has deemed the breach of conduct as “serious” but not “very serious,” this decision has unfortunately become a setback for the Spanish government. As a result, Rubiales cannot be suspended from his role as the president of the Royal Spanish Football Federation (RFEF). However, an investigation will follow, and there is a possibility that Rubiales may face a ban of up to two years from football. This ruling is based on Spain’s 1990 sports law, which is considered more lenient as the more recent update is yet to be implemented. Nevertheless, the government, through the Superior Sports Council (CSD), still intends to pursue Rubiales’ suspension via TAD. The Minister of Culture and Sports, Miquel Iceta, has expressed the belief that Rubiales’ offenses should be considered “very serious” and intends to file a request for the court to take that position.
Had TAD classified the infraction as “very serious,” the government would have had the power to immediately suspend Rubiales from his position. However, in this case, Rubiales may potentially resume his presidency once his 90-day provisional suspension imposed by FIFA ends. It is important to note that there is also the possibility of a criminal case and subsequent criminal penalties for Rubiales. Spanish prosecutors have already initiated a preliminary investigation into his conduct and are offering Hermoso the opportunity to press charges against him. Despite the mounting pressure from various sporting bodies and government ministers calling for his resignation, Rubiales has so far refused to step down. His behavior after Spain’s victory over England in the World Cup final, including grabbing his crotch, hugging and kissing players, and carrying someone on his shoulder, has led to condemnation and demands for change.

De la Fuente has since apologized, acknowledging that his actions were “unjustifiable” and deserving of the criticism received. However, some have called for his resignation due to the delay in speaking out against Rubiales. De la Fuente, while expressing regret for his actions, has not made a definitive stance on whether Rubiales should be removed from his position. He believes that the relevant bodies should resolve the situation first before making further evaluations. Nevertheless, he recognizes the need for continuous efforts to improve equality within football and commits to rectifying his mistake.
